Passing The Blame!

The ex president felt that it was much easier to pass blame for all his blunders concerning the path/walkway, and on Monday, November 24, 2008 he wrote this on his web site;  Unbelievable!Nobody could make this stuff up – it’s just too crazy !” “ In “Watchdogone’s” last rant, posted on November 21st, the “Watchdog” goes to the extreme to make a case that the BOD in general and the “ex-President” specifically, stopped all path maintenance to “attack” the county and the developer thereby forcing them to do the maintenance “. “Does “Watchdogone” think we have all forgotten that it was THE OWNER of the WATCHDOG website that filed a formal complaint with the Illinois Department of Agriculture.” “Doesn’t “Watchdogone” understand that it was this filing that halted all attempts to control the weeds on the path while a full investigation was conducted and it was during this time that the weeds grew out of control.”

It so much more convenient to blame someone else for ones missteps than taking any responsibility. It’s really the adult thing to do.

    The ex president blames my contacting the Illinois Department of Agriculture as the reason for the weeds and vegetation growing out of control on the walking path. The ex-president again plays the blame game and will not admit what he openly stated to the membership at the August 2nd HOA meeting, at which time he said that all maintenance work on the path had been stopped by him, in ’HIS ’ attempt to show the county and the developer’ HIS’ displeasure with the path construction.

    First, the report filed with the Dept of Ag, was solely related to the area referred to as the Prairie Grass Project, which means the areas of grass and weeds adjacent to the walking path most SPECIFICALLY for lot #58. As explained to me by the Dept. of Ag investigator, the Dept. of Ag has no jurisdiction over the walking path. Under the Illinois Pesticide Act, 415 ICLS 60/1 ET. SEQ, this act refers only to areas that are 100 % turf, not a combination of grass and weeds and surely not crushed lime stone as is the walking path.

    On 5/16/08 I sent an email to the BOD asking for specific information if/when the board had sprayed a herbicide along the areas thus referred to as the Prairie Grass Project. I then left a message at the ex-president’s home asking him to return my phone call. No call was ever returned. On 5/16/08 Mr. Duffy, board member, sent an email to me stating he had no knowledge of the planting or the spraying. On 5/29/08 the ex-president finally replied to me stating the herbicide/vegetation killer used was “ Round Up “ which is widely used and is one of the safest around. However, it is still labeled as a toxic total vegetation killer and precautions should be taken.

    Weeks after my email of 05/15/08, stating my concerns in reference to the toxic spraying without membership notification, the association’s landscaper was spraying the walking path with a toxic vegetation killer, at the same time a homeowner was walking her dog on the path. The landscaper advised the dog walker to turn around and get off the path as it was not safe for her and her dog.

    On June 3rd, I advised the BOD that I had contacted the Illinois Department of Agriculture and made a formal complaint for possible misuse of a pesticide on the common area behind LOT 58. This report HAD NO relationship in any way to the walking path. The reporting investigator came out to my home, took my statement and took pictures of the common area behind lot 58 exclusively. The reporting investigator advised that since the area behind lot 58 was more weeds than grass, he did not feel it would meet the letter of the law as it pertains to misuse of a pesticide. IF the area was
    100 % grass, it would have been a violation for a commercial sprayer to apply the chemical without proper notification. The investigator then notified the ex-president of my complaint. Several weeks later the investigator met personally with the ex-president then stopped at my home to advise me of his conversation. The investigator stated that he gave suggestions to the ex-president such as that future sprayings should be announced to the membership in advance and most specifically to the members whose homes would be adjacent to the sprayed areas, as well as, notification should also be announced on the HOA web site. On August 3rd, board member Cara Koen posted a notice on the HOA web page stating that the association would be conducting a spraying of a toxic vegetation killer along the entire walking path. Postcards were also sent. Shortly thereafter, the ex-president cancelled this spraying and any future spraying, as his intent was to show the county and the developer how bad the path had become. In fact, the ex-president canceled all future sprayings of the pathway even as the landscaping contract stated that there should be once a month weed/vegetation control.

    For the ex-president to blame me for the weeds and vegetation growing out of control on the walking path is ludicrous, totally false and very predictable behavior for this man. This style of behavior has been on-going since January. For him to pass blame and not accept responsibility for his mistakes and then making up deceitful statements is nothing out of the ordinary, especially as it pertains to anything connected to me or my wife Paula Mueller. It is easier to pass blame on others than it is for him to admit to having made a mistake or he had a lack of judgment. Numerous members at the August 2nd HOA meeting heard the ex-president openly state what his motives were for not maintaining the walking path. I even asked that question of him publicly. Never once did he state it was because of the complaint with the Dept of Ag. The ex-president was told in no uncertain terms by the Dept of Ag investigator that the possible misuse of a pesticide complaint related exclusively to the common area behind lot 58 adjacent to the walking path. The ex-president intentionally and conveniently did not mention that point of contention. The Dept of Ag investigator adamantly stated that this situation concerned only the spraying of grasses/weeds behind to lot 58……not the spraying of the composition of crushed limestone used in the construction of the walking path.

    In case the ex president has forgotten, the following is an email notification that he sent to his board stating HE told Yingling landscaping not to spray the path. This is in direct conflict to his aforementioned blog posting in which he blamed me for the condition of the path. Also please observe the email date of July 22, 2008. I guess the ex president forgot that he alone had stopped the maintenance of the path and chose to just blame me. It is so much easier for the ex president to make up half truths and blame the Mueller‘s for everything wrong within this development. Remember, he along with his cohorts claim we are internet bullies, so I guess that would make the ex president the internet liar and his email just goes to prove it. Also, please remember that developer Joe DePaulo, the person responsible for the construction of this path/walkway, openly stated in the spring of 2008, that he would do nothing further concerning the repairing or maintenance of the path project. So concerning the path, if the county was not going to repair/maintain and the developer was not, who should have been concerned for making it safe for the homeowners? FYI…The path was only sprayed once in early spring, and the BOD took no additional steps to ensure its safety, meaning no spraying or repair of any kind. The weeds and grasses kept growing and growing through the crushed limestone path and the path became so unsafe that the BOD posted a notice to the membership that the path should not be used. Anyone taking blame/responsibility for this? But someone is quickly passing the blame.

    I have been in contact with the county re the inspection of the path. They have completed their inspection and have forwarded a punch list to the developer for completion before September 1st. Included on the list is the removal of weeds from the path. Based on this information I have asked Jim Yingling not to spray the path until we have had a chance to discuss the situation.
